Terms governing access to iMart and participation in its direct digital-product marketplace.

1. About these terms

These Terms of Use govern access to iMart and participation in its Australian direct marketplace. References to iMart, we, us or our mean the business operating the marketplace. Current business and contact details will be displayed through iMart's legal and support channels.

2. Agreement and eligibility

By creating an account or using an account-only feature, a user agrees to the published version of these terms and the policies incorporated into them. A user must provide accurate information and be legally able to enter the relevant contract. Where a person cannot contract independently, an eligible parent or legal guardian must own and control the account and accept responsibility for its activity.

3. iMart's marketplace role

iMart provides marketplace discovery, account, checkout-facilitation, digital-delivery, communication, moderation and support tools. For every creator product, the creator is the seller and merchant of record and the buyer contracts with that creator. iMart is not the seller of a creator product and does not acquire ownership of it. The product page, checkout, order confirmation, receipt and invoice must identify the applicable creator seller. A cart containing products from different creators may produce separate payments, orders and receipts. iMart may enforce marketplace policies and assist with a transaction without becoming the product seller.

4. Accounts and security

Users are responsible for protecting credentials and for activity performed through their accounts, except to the extent caused by iMart or another party. Users must promptly report suspected unauthorised access and must not impersonate others, transfer accounts without approval or evade a restriction.

5. Buying products

Before payment, buyers should review the seller identity, product description, compatibility, price, licence, delivery method and any seller-specific terms. A completed payment forms a purchase contract between the buyer and the identified creator. Purchases remain subject to Australian Consumer Law and other rights that cannot lawfully be excluded.

6. Using iMart lawfully

Users must comply with the Acceptable Use, Prohibited Products, intellectual-property and moderation policies. They must not misuse payment systems, manipulate reviews, introduce malicious code, obtain unauthorised access, scrape protected data or move an iMart transaction off-platform to avoid fees or protections.

7. Availability and third-party services

iMart may use third-party payment, hosting, communication and security services. Features may change, be interrupted or be withdrawn, but nothing in these terms excludes a guarantee that legally applies to iMart's own services.

8. Enforcement, liability and changes

iMart may remove content or restrict features where reasonably necessary for safety, fraud prevention, payment risk, legal compliance or policy enforcement. Where appropriate and lawful, affected users will receive notice and an opportunity to request review. Nothing in these terms excludes, restricts or modifies a right, guarantee or liability that cannot lawfully be excluded, restricted or modified.
