Terms of Use

For Emotional Chat Coach (IOS App)

Thank you for using Emotional Chat Coach (the App). These Terms of Use set out the rules for using the App. By using the App, you agree to these Terms. If you do not accept them, please discontinue use. We may update these Terms from time to time and will post the latest version on our website.
Your use of the App is also subject to our Privacy Policy, available on our website.

Ownership and control


The App and its content are owned and operated by Delta Insight Consulting (DI). References to “we”, “us”, and “our” in these Terms refer to DI.

Purpose of the App


Emotional Chat Coach provides AI assisted communication coaching and message suggestions. The App is not medical, psychological, legal, or financial advice.

 

Eligibility


You must be at least 13 years old to use the App.

Your account


You are responsible for maintaining the confidentiality of your account and for all activity under your account.

Acceptable use


You must not use the App in a way that:

  • Breaches any law or regulation.

  • Harasses, abuses, or harms others.

  • Disrupts or interferes with the App or its security.

  • Attempts to reverse engineer, scrape, or misuse the App.

 

Intellectual property


Unless otherwise stated, all content, branding, and software in the App are owned by or licensed to DI.
We grant you a personal, limited, non exclusive, non transferable licence to download and use the App for your personal, non commercial use, subject to these Terms.
You may not copy, reproduce, or redistribute any part of the App without prior written permission.
Your use of the App may also be subject to Apple’s standard End User Licence Agreement, unless a custom licence agreement is provided in App Store Connect.

 

In App Purchases and Subscriptions

Emotional Chat Coach offers both consumable purchases and auto renewing subscriptions through Apple In App Purchase.

Consumable Purchases

Reply credit packages, including 3 Replies and 8 Replies, are consumable digital products. These credits are used to generate coaching responses within the App.

Consumable purchases:

  • ​Are non transferable

  • Do not auto renew

  • Are not restorable through Apple’s Restore Purchases function

  • Cannot be recovered if the App is deleted or reinstalled

  • Cannot be transferred to another device or Apple ID

  • Are non refundable except as required by applicable law

Auto Renewable Subscription

The Monthly Subscription provides unlimited replies and access to custom tones.

The price displayed in the App Store at the time of purchase is the final price charged to your Apple ID account.

 

The subscription:

  • Renews automatically every month unless cancelled at least 24 hours before the end of the current billing period

  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing period.

  • Will be charged to your Apple ID account at confirmation of purchase

  • Can be managed and cancelled through your Apple ID account settings

 

To manage or cancel your subscription, open:
Settings → Apple ID → Subscriptions

If you reinstall the App or change devices, your active subscription associated with the same Apple ID can be restored using the Restore Purchases feature within the App.

Refunds and Billing

  • Purchases in the App are processed by Apple through the App Store. Refund requests must be submitted to Apple, for example via Apple Support or reportaproblem.apple.com. Apple determines refund outcomes under its policies.

  • Monthly subscriptions may be cancelled at any time in Apple ID account settings. Cancellation stops future renewals and access continues until the end of the current billing period. No partial or pro-rata refund is provided by us.

  • Deleting your account does not automatically create a right to a refund for reply packs or subscription charges.

  • Purchase and transaction records may be retained after account deletion where required for legal, tax, accounting, fraud prevention, or dispute handling.

 

Disclaimers


The App is provided on an “as is” and “as available” basis. We make no warranties about the accuracy, completeness, or suitability of content. Outputs may be incorrect or inappropriate and should be reviewed before use. You use the App at your own risk, and you remain responsible for the messages you send and any outcomes that result.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable laws that cannot be excluded.



Limitation of liability


To the maximum extent permitted by law, we exclude liability for indirect or consequential loss, loss of profit, loss of data, or business interruption arising from your use of the App. This does not exclude liability that cannot be excluded under the Australian Consumer Law or other applicable laws.

Third party services


The App may rely on third party services (including Apple services). Their terms and policies may also apply to your use of those services.

Termination


We may suspend or terminate access if you breach these Terms or misuse the App. On termination, you must stop using the App, and we may remove or restrict access to the App and its features. Account deletion does not affect records we are legally required to retain.

Availability


App availability and features may change from time to time to improve the service, maintain security, or comply with legal requirements.

Changes to these Terms


We may update these Terms from time to time. Any changes will be posted on our website with an updated effective date. Continued use of the App after changes are posted means you accept the updated Terms.

Governing law


These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non exclusive jurisdiction of the courts of New South Wales.
